Terms for club shops

OLB Sports OOD (Bulgaria, EU), operating the Flare Custom brand. Last updated: October 2026.

Terms applicable to club shops created and hosted by Flare Custom, for the club that opens its shop and for the buyers who order from it. They supplement the general terms and conditions of sale (the General Terms). In this document, articles followed by the words “of the General Terms” refer to those general terms; all other articles refer to this document.

1. General Provisions

These special terms govern club shops (Article 2): the relationship between Flare Custom and the club, and sales concluded with the shop's buyers. They supplement Articles 1 to 15 of the General Terms. In the event of conflict, these special terms prevail over the General Terms, and the terms accepted in a signed quote or displayed in the shop or in the club's management area at the time of the order prevail over these special terms.

1.1. The club and the buyers

The club (sports club, association, school, company) acts for its activity: Article 13 of the General Terms (specific provisions for business customers) applies to it. The shop's buyers (players, parents, supporters) may be consumers: they then enjoy the rights granted to them by the General Terms and applicable law, subject to the exception to the right of withdrawal for personalised items (Article 2.7).

1.2. Prices and VAT

Prices shown to buyers include all taxes (VAT included), in euros. The VAT applied and the exact price, including delivery, are shown before payment. Prices and the club's commission are set out in Article 2.3.

1.3. Payment

The buyer pays 100% of the order online, at the time of ordering, by bank card, through our secure payment provider (Stripe) (Article 2.4). Opening the shop costs the club nothing (Article 2.2). For orders placed by the club itself, the principle of Article 3.4 of the General Terms applies: 100% payment at the time of order. Any other payment schedule is only possible upon the club's written request, after review of its file and written agreement of Flare Custom; it is never granted by default and creates no right for subsequent orders.

1.4. Management area and access

The shop's management area is personal to the club. The club is responsible for keeping its access credentials confidential and for any action carried out from that area (choice of products, prices, personalisation rules, approval of names). Flare Custom may suspend access or pause a shop in the event of fraudulent use, attempted intrusion or serious breach of these terms, after informing the club except in an emergency. The buyer is responsible for the information it enters (address, name, number, size).

1.5. Changes to prices and services

Flare Custom may change its prices and the way club shops work. A price change does not apply to orders already paid. Shop features may be improved or replaced by equivalent features.

1.6. Confidentiality of workshops and suppliers

The identity, contact details and terms of Flare Custom's workshops, manufacturers and suppliers are confidential information. They are not disclosed to any customer, whether in commercial documents, on products or in exchanges.

2. Club Shops

2.1. Purpose and roles

A club shop is an online shop in the colours of a club or organisation, on which its members (players, parents, supporters) buy the items chosen by the club. Unless otherwise stated on the shop, sales are concluded between the buyer and OLB Sports OOD, which manufactures and sells the items. The club chooses the products, designs, prices, personalisation rules and delivery methods; it is responsible for the information it publishes and for the rights to its logos and visuals (Article 7.2 of the General Terms).

2.2. Creating the shop

Club shops hosted by Flare Custom are created only by Flare Custom, for its own club customers. Creating the shop is free of charge for the club: Flare Custom is paid through its margin on the items sold. These terms only apply to shops hosted by Flare Custom; a shop opened with another seller is governed by that seller's terms.

2.3. Prices and club commission

The club sells at the Flare Custom price or adds its margin. When it adds a margin, the bank fees on payments are shared equally between Flare Custom and the club: the club's half is deducted from its commission. Without a margin, Flare Custom bears these fees. The club's commission is shown in its management area. It is paid by bank transfer on the 10th of the following month, only on orders that have been delivered and have no claim in progress, from €50; below €50, it is carried over to the following month. At the club's choice, it can instead be paid as a voucher to be used on flare-custom.com, worth the commission plus 10%. Prices displayed to the buyer include VAT; the VAT applied and the exact price are shown before payment. Sizes 3XL to 5XL carry a 5% surcharge.

2.4. Orders, payment and batches

The buyer pays 100% of the order online, by bank card, at the time of ordering. Depending on the shop setting:

  • Automatic batches: each item can be bought “right away, individually” (price for one piece, under the small-quantity rule of Article 3.1 ter of the General Terms; produced as soon as paid) or “with the group” (price of the batch quantity tier; produced as soon as the number of pieces set for that product is reached, 5 by default, all sizes and names combined). If the batch takes time (30 days by default), the buyer receives a link to pay the difference and have the piece produced individually; otherwise the piece remains reserved at the group price. Flare Custom or the club may launch an incomplete batch at no extra cost to the buyer. No paid order is refunded on the grounds that the batch is not yet complete.
  • Pre-order: orders are grouped and produced on the closing date set by the club, with a minimum number of pieces per product where displayed on the shop.

2.5. Personalisation

The name, number and size are printed exactly as entered by the buyer. Depending on the club's rules, a number may be allocated only once, or names may be approved by the club before production. An input error can be corrected only before production starts, by replying to the confirmation e-mail.

2.6. Delivery

Depending on the methods offered by the shop: collection at the club (grouped shipment to the club, with a flat shipping contribution per piece shown in the basket) or home delivery (actual transport price according to the country, calculated in the basket). Lead times are indicative (Article 4.4 of the General Terms).

2.7. Right of withdrawal

Items sold on a club shop are made to order, in the club's colours and design and, where applicable, with the buyer's name and number. In accordance with Article 16(c) of Directive 2011/83/EU and the corresponding article of the Bulgarian Consumer Protection Act, the right of withdrawal does not apply to these goods made to precise specifications or clearly personalised (Article 8.2 of the General Terms). They are neither taken back nor exchanged, except in case of defect or non-conformity.

2.8. Warranties and claims

A consumer buyer benefits from the 2-year legal guarantee of conformity (Article 6.1 of the General Terms) and the mandatory rights granted by applicable law. Claims are made via the “Report a problem” module or to support@flare-custom.com (Article 5.3 of the General Terms).

2.9. Club levels

Clubs may benefit from a loyalty programme based on their volume excl. VAT over a rolling 12 months (sales from their shop and group orders): an end-of-season credit, as a percentage of the season's volume, to be used on subsequent orders within the stated period. Thresholds, percentages and validity periods are those displayed in the club's management area. A credit is never refundable in cash.

3. Intellectual Property

  • Elements provided by the club (logos, crests, trademarks, visuals, photos, texts, lists of names): they remain the property of their holder. The club warrants that it holds the rights to them and indemnifies Flare Custom against any third-party claim (Article 7.2 of the General Terms). It authorises Flare Custom to reproduce them to present the shop and manufacture the items.
  • Flare Custom's creations (designs, proofs, 3D renderings, shop visuals and pages): they remain the property of OLB Sports OOD (Articles 10.2 and 10.2 bis of the General Terms), unless there is a written assignment agreement. The club may use them to promote its shop and the items manufactured by Flare Custom.
  • Promotion: Article 10.3 of the General Terms applies.

4. Liability

Flare Custom has a best-efforts obligation for the operation of the online shop and an obligation of result for the conformity of the items with the design approved by the club, within the tolerances of Articles 2.4 and 14.13 of the General Terms. The club is responsible for the information, prices and visuals it has published on its shop (Article 2.1). Towards the club, indirect damage (loss of turnover, image, data) is excluded and, for a product order, Article 14.2 of the General Terms applies. These limits do not apply in the event of gross negligence or fraud, nor to the mandatory rights of consumer buyers (Article 2.8).

5. Disputes, Mediation and Applicable Law

Articles 11 and 12 of the General Terms (force majeure; dispute resolution and mediation) apply. These terms are governed by Bulgarian law and European Union law (Article 12.1 of the General Terms). Disputes with the club, acting for its business, fall within the exclusive jurisdiction of the courts of Sofia (Article 12.5 of the General Terms), after an attempt at amicable settlement in writing (Article 12.4 of the General Terms). Consumer buyers may use consumer mediation free of charge, in particular with the Bulgarian Commission for Consumer Protection (KZP, www.kzp.bg) or the body of their own country via the European Consumer Centres network (Articles 12.2 and 12.3 of the General Terms), and retain the possibility of bringing proceedings before the courts of their place of residence.
